Indenture between heirs of George Shambough and Samuel Grove

This Indenture made the sixteenth day of March in the year of our
lord one thousand eight hundred and four between Philip Shambough and Peggy
his wife Daniel Shambough and Catharine his wife and Jacob Snider and dorethy
his wife part of theirs of George Shambough Deceased & on behalf &
for all the said Heris o fhte one part, and Samuel Grove of Hampshire
County Virginia of the other part, Witnesseth, that for and in consideration
of the sum of one dollar current money of the united states, of America in
hand paid by the said Samuel Grove to the said Philip Shambough Daniel Shambough
& Jacob Snyder at or before the sealing and delivery of these presents,
the receipt whereof they do hereby acknowledge, and thereof do release, acquit
and discharge the said Samuel Grove his Executors, and administrators, by
these presents, the said Bargainors have granted bargained, sold, aliened
relased and confirmed, and by these presents, do grant bargain, sell, alien,
release and confirm unto the said Samuel Grove and his heirs one tract of
land on Huges Run in the said County of Hampshire & commonwealth of Virginia
the tract whereon the said George Shambough Decd. late died seized (or died
seized of) and hedging Intestate the said Philip Shambough Daniel Shambough
& Dorethy Snyder formerly Dorethy Shambaough with others are Heirs of
the said Intestate and of course owners of his land which they sold to said
Samuel Grove and have received payment from him but the bargainers herein
have not yet executed a deed to him agreeable to law but now which to do
so, the other heirs have not Legally ade a conveyance of their right
is said land the deed they made being deemed informal however it is will
known they are willing to do what is right towards said Grove of which the
Bargainers herein are so sensible that they here undertake in manner mentioned
in the first part of theis deed, the said land is bounded as followeth Beginning
at a large pine at the foot and south side of a Mountain and No of Huges
run running thence across said run No 45 E 283 poles to tow pines on the
north side of a ridge in a stony place thence across the ridge S 66 E 200
poles to a locust a chesnut and a block oak on the N side of Capoon in a
stony place thence along the hillside S45 W283 poles to a spanish and white
oak on the north side of the said Mountain & thence across a branch of
Huges run No 66 W 200 poles to the beginning containing 302 acres & 2
rods more or less which said Tract of Land was granted by patent from Lord
Fairfax to Andrew Thompson and by him conveyed conveyed to the aforesaid
George Shambough (the Intestate) and the conveyance now of record in the
county of Hampshire County aforesaid and all houses, buildings, Orchards,
Ways, waters, watercourses, profits, commodities, heriditaments, &
appurtenances whatsover, to the siad premises hereby granted or and part
thereof belonging or any wife appertaining: and the reversion and reversions,
remainder and remainders, rents, issues and Profits thereof, and also all
the estate, right, title, Interest, use, trust, property and demand whatsoever
of them the said Bargainers of in and to the said Premises and all deeds,
evidences and writings, touching or in anywise concerning the same To
have and to hold the lands hereby conveyed, and all and singular other the
premises hereby granted and released, and every part and parcel thereof with
theri appurtenances, unto the said Samuel Grove his heirs and assigns forever
to the only proper use and gehoof of him the said Samuel Grove and of his
Heirs and assigns forever. and the siad Bargainers for themselves their heirs
Executors, and administrators, do covenant promoise & grant to and with
the said Samuel Grove his heirs and assigns, by these presents, that the
said Bargainers (as aforesaid) now at the time of sealing and deliver any
of these presents are seized of goods sure perfect and indefeasible estate
of Inheritance, in fee simple of and in the premises herby granted and released
and thaty they have god power and obsolute authority, to grant and convey
the same to the said Samuel Grove in manner and form aforesa. and that the
said premises now are , and forever hereafter shall remain, to be free and
clear of and from all other gifts, grants, bargains, sales, dower right and
title of dower, Judgments, executions, titles troubles, charges &
encumbrances whatsoever, made, done, committed or suffered by the Said
Bargainers or any person or persons whatsoever. And Lastly that the said
Philip Shambough Daniel Shambough & Jacob Snyder and their Heris, all
and singular the premieses hereby granted and released with the appurtenances
unto the said Samuel Grove his heirs and assigns, against the said Daniel
Philp and Jacob and their heirs so all and every other person and persons
whatsoever, shall warrent & forever defend by these presents. In
Witness whereof the said Bargainers have hereeunto set their hands and seals
the day and year first above written.

| At a superior court continued and held for the district composed
of the counties of Frederick, Berkley, Shanandoah, and Jefferson at Winchester
the 17th day of April 1804
This Indenture was proved as to these do Jacob Snider by the oaths of Reed Weifht and George Snider and acknowleded by Dorthy the wife of the sd Jacob she being first examined as the law Directs & the same was acknowlegged by the said Philip Shambough & Peggy his wife & by the sd Daniel Shambough & Catharien his wife the said Peggy and Catharine being first privily examined as the law Directs & ordered to be recorded as to the sd. Dorothy Philip Shambough & Peggy his wife & Daniel Shambough & Catharine his wife by the court. Peyton B W D E |
